DYNEEMA® Trademark Announcement

DSM Dyneema B.V. and DSM IP Assets B.V., both companies established under the laws of the Netherlands (hereinafter jointly referred to as “DSM”) are the owner of the registered trademarks DYNEEMA® in Latin and DYNEEMA® in Chinese, i.e. 迪尼玛® and 大力马®. DSM also owns exclusive rights onto the word DYNEEMA as a trade name.&

DSM is the inventor and manufacturer of Ultra High Molecular Weight PolyEthylene (UHMwPE) fiber, which is marketed under the trademark DYNEEMA®. The DYNEEMA® UHMwPE fiber offers maximum strength combined with minimum weight. It is up to 15 times stronger than quality steel and up to 40 percent stronger than aramid fibers, both on weight-for-weight basis. The DYNEEMA® UHMwPE fiber floats on water and is extremely durable and resistant to moisture, UV light and chemicals. The applications of the DYNEEMA® fiber are therefore more or less unlimited. The DYNEEMA® fiber is an important component in ropes, cables and nets in the fishing, shipping and offshore industries and is also used in safety gloves for the metalworking industry and in fine yarns for applications in sporting goods and the medical sector. In addition, the DYNEEMA® UHMwPE fiber is also used in bullet resistant armor and clothing for police and military personnel.

The DYNEEMA® UHMwPE fiber from DSM is produced in Greenville, North Carolina (U.S.) and Heerlen (The Netherlands). DSM Dyneema is also a partner in a high modulus polyethylene (HMPE) manufacturing joint venture in Japan. The genuine DYNEEMA® and 迪尼玛® polyethylene fiber (also known as UHMwPE fiber) is only provided by DSM and its partners and only DSM’s licensees are authorized to use the trademark DYNEEMA®. Unauthorized use of DSM’s trademarks/trade name as trademarks/trade name or use of these trademarks/trade name as a generic term is strictly prohibited under applicable laws and regulations in China, and gives rise to administrative, civil and criminal liabilities.

Based on the prior rights of DSM onto the trademark DYNEEMA® and 迪尼玛®, the principle of mutual respect, fair trading and professional courtesy and for the sake of protecting public interests, DSM has been working closely with the Chinese IP enforcement authorities to stop the generic use or unauthorized use of the said trademarks/trade name.

For your information, the proper generic term for the relevant fiber is “UHMwPE” or “polyethylene fiber” or “UHMwPE fiber”. As explained above, use of the trademarks/trade name DYNEEMA® as a generic term for UHMWPE fiber is not correct, and cannot be tolerated by DSM, and such use is also expressly and strictly forbidden under the PRC Trademark Law.

Meanwhile, we hereby emphasize that authorized use of the registered trademarks DYNEEMA®, 迪尼玛®, 大力马® is strictly limited to the licensees of DSM. Use of the trademark DYNEEMA® in Latin or Chinese without such license from DSM on goods covered by the trademark registration or as a generic term constitutes trademark infringement.
